TUPE Transfer

Our employment team represented live in stewards of a private members club, who were dismissed when the club was sold. We issued a claim for unfair dismissal and failing to inform and consult about a TUPE transfer. The new owner made an application to strike out the claims and for a deposit order to be made. We represented the claimants at the hearing and were successful in resisting this application. We negotiated an agreed settlement for both clients with the new owner a short time later.

Unlawful deduction of wages

An employee whose employer failed to notify her that they were changing owners, and terminated her employment without consultation, instructed us to represent her. Following proceedings being issued, we successfully represented the claimant and settled the matter for £8,250 on the grounds of: unfair dismissal, unlawful deduction of wages, failing to provide a contract or pay statements and failing to inform and consult about a TUPE transfer.

Unfair Dismissal

We were instructed to represent an employee who was dismissed for her inability to perform work duties as a result of her health. We successfully settled the matter for £10,000.

Settlement Agreement

Upon return from annual leave, our client met with her line manager who told her that the employer was looking to dismiss her because of what they alleged as poor performance. We negotiated with the employer over the terms of a settlement agreement, and the employer paid the sum of £16,250 to the employee.

Settlement Agreement

We acted for a Professional Development Manager who worked for a legal services organisation. The organisation was looking to terminate the employee’s contract of employment. We advised the client upon the terms of the settlement agreement and suggested several amendments to the agreement. These were communicated to the employer, along with some further queries. As a result of the settlement agreement being finalised, the employee then received the sum of £16,100 from the employer.

Following the agreement being finalised, the client was very pleased with the result, so much so that he recommended his solicitor to a colleague who is now also receiving advice from us upon their employment situation.
