Compromise agreement review

Our client was employed by a large organisation who gave him a settlement agreement with six months’ notice pay. He was happy with the settlement, but he contacted DAS Law to review the detail.

We managed to resolve the tax treatment of this payment which was incorrect in the settlement agreement and would have left him open to a claw back under the tax indemnity and secure an additional £12,000 for him as compensation as well as an additional six months use of the company car.

In this case the employee paid no personal contribution to the settlement agreement and the employer paid our fees direct.

Redundancy settlement

Our client was a senior executive with a substantial benefits package. He had been an employee for over 10 years when he was advised that a company re-structure was to be undertaken and his position was ‘at risk’. Our client felt it was time to move on and discussed a settlement agreement with his employer.

In the end, we secured a period of garden leave for him so that he did not have to work his notice, as well as a release from the restrictions contained in his employment contract.
